Accellion $8 Million Data Breach Settlement | efani Partner TheNFG.com

Accellion $8.1 million class action settlement for breach platform that allowed companies to securely share large or sensitive files. Accellion has protected over 25 million end-users at more than 3,000 global corporations and government agencies, including NYC Health + Hospitals; KPMG; Kaiser Permanente; Latham & Watkins; National Park Service; Umpqua Bank; Tyler Technologies; and the National Institute for Standards and Technology (NIST).

The nationwide class action proposed to end litigation over the security breach of file transfer product. The legacy product, according to settlement papers filed in California federal court, of the Palo Alto-based tech company faced claims that it failed to properly secure sensitive personal information of millions of individuals after hackers exploited a vulnerability in Accellion’s platform, according to a motion for preliminary approval of the settlement, filed by the plaintiffs’ lawyers on Wednesday.

In the proposed class, millions of individuals whose data was stored by companies that used Accellion’s file transfer product, in a recently amended complaint said information including names, birthdates, Social Security numbers, medical and drivers’ license information was exposed.

The current settlement would resolve claims only against Accellion, but there are pending agreements in cases against several Accellion clients over the incident, according to the Wednesday filing.

Supermarket chain Kroger Co has agreed to a $5 million settlement, which has received preliminary court approval. There are also pending settlements with Flagstar Bancorp Inc and Health Net LLC, a subsidiary of managed care company Centene Corp, the plaintiffs’ lawyers said. The Kroger Co. (NYSE: KR) Family of Companies today confirmed it was impacted by the data security incident affecting Accellion, Inc.

A representative for Accellion (which rebranded in October 2021 to Kiteworks), said the company doesn’t comment on litigation. Lawyers for the company from Latham & Watkins didn’t immediately respond to requests for comment on Thursday, nor did a lawyer from Ahdoot & Wolfson for the plaintiffs.

The case is Stobbe v. Accellion Inc, U.S. District Court for the Northern District of California, No. 5:21-CV-01353.

For the plaintiffs: Tina Wolfson of Ahdoot & Wolfson

For Accellion: Melanie Blunschi and Michael Rubin of Latham & Watkins

Hacks are getting too frequent Hot wallet hacks are becoming more and more frequent. Recently, Bitmart lost $ 196 million when two hot wallets were hacked on December 5, 2021, resulting in the loss of ETH and BSC. Bitmart has promised to return the funds, but affected customers are growing impatient.

AscendEX disabled deposits after $77M worth of ERC-20, BSC, and Polygon tokens were transferred out of its hot wallet on Dec. 11, 2021.

Japanese exchange Liquid Global confirmed the hack of their hot wallets in August 2021. They moved all assets to cold storage wallets and suspended deposits and withdrawals.

Hot wallets have the advantage of being easy to use because they are always online. They come in the form of web-based wallets, mobile wallets, and desktop wallets. Cold wallets are offline and often come in the form of a USB flash drive, otherwise known as a hardware wallet. Hardware wallets are immune to hacking.

The LCX token has fallen 9.8% in the past 24 hours. It is “a long-term sustainable incentive mechanism to motivate various stakeholders to participate in the ecosystem”. The LCX token is issued by LCX AG in accordance with the laws and regulations of Liechtenstein. Based on assessments from law firms, the LCX token can be classified as a utility token under the laws of the United States, Singapore, and Liechtenstein.

$2.2 Million NFT Scam All My Apes Are Gone Bored Ape NFT Theft Stolen

Theft of Non-Fungible Tokens (NFTs) appears to be on the rise, with many collectors losing millions of dollars as a result. In one recent example that led to widespread mockery, an NFT investor complained “all my apes are gone,” referring to the popular “Bored Apes” and “Mutant Apes” NFTs they had invested in. Todd Kramer, an artist who is a member of the Bored Ape Yacht Club (BAYC), took to the microblogging platform, Twitter, to reveal that he lost $2.2 million worth of the NFTs to phishers. This resulted from the artist’s clicking on a malicious link represented as a crypto-app gateway. On realization that he has been defrauded, Kramer took to Twitter to post:

All my apes are gone should be the phrase to define 2021. pic.twitter.com/PeTW5SFYXL

— Sigh* (@rlyboredsigh) January 2, 2022
This week alone, Bored Apes surmounted $1billion in overall sales, despite being launched last April. In the last 30 days, CryptoSlam has reported a rough estimate of $7.4 million worth of trades. Bored Apes, an easy target for fraudsters? Many celebrities such as Jimmy Kimmel, Shaquille O’Neal, Serena Williams, Eminem have bought Bored Apes. However, famous holders and rising prices have made it known that this is a season for scammers, hackers, and fraudsters ready to swindle NFT newbies. The majority of NFTs stole were part of the Bored Apes and Mutant Apes NFT collections. Kramer took to Twitter immediately and begged for OpenSea to help him and called out to the NFT to aid him in recovering his NFT apes. Others of course immediately made fun of Kramer, telling him to change his profile picture featuring one of the Apes as he was no longer the owner of the NFT. Many were quick to note that OpenSea intervening in the situation seemed to go against a key value of the industry, which is that “code is law” and that once your tokens are in someone else’s wallet, they own them. OpenSea could not reverse the transaction on the blockchain but it did stop the NFTs from being sold on its marketplace. OpenSea stated: “We take theft seriously and have policies in place to meet our obligations to the community and deter theft on our platform. We do not have the power to freeze or delist NFTs that exist on these blockchains, however, we do disable the ability to use OpenSea to buy or sell stolen items. We’ve prioritized building security tools and processes to combat theft on OpenSea, and we are actively expanding our efforts across customer support, trust and safety, and site integrity so we can move faster to protect and empower our users.” Some people are of the belief that their Social Security Number (SSN) is the most valuable number. UScellular Data Breach Billing System Hack | efani Partner TheNFG.com

UScellular exposes customer personal data and billing info in a second data breach that hit the fourth largest Carrier in 2021. Hackers successfully gained access to the carrier’s customer data and CRM software in January and again in December 2021. UScellular, the mobile carrier, said in data breach notification letters sent to 405 impacted individuals that the attackers also ported some of the affected customers’ numbers using personal information stolen in the incident. I bet these customers wish their carrier protected their data. Following the December breach, the threat actors were also able to successfully port some UScellular customers’ numbers which would allow them to steal two-factor authentication codes sent via text messages and, potentially, hijack the victims’ online accounts. This is a classic SIM Swap attack or SIM jacking event which puts customers at major risk of identity and other fraud. “On December 13, 2021, UScellular detected a data security incident in ‘which unauthorized individuals illegally accessed our billing system and gained access to wireless customer accounts that contain personal information,” the carrier explained. UScellular also reset the impacted customers’ security questions, answers, and personal identification numbers (PIN) linked to their accounts, but that does little after the fact now that the data is in the possession of the hackers and scammers. Some people are of the belief that their Social Security Number (SSN) is the most valuable number. In reality, your mobile phone number is even more valuable to hackers and scammers. Take the recent data breaches as an example. Scammers can use the breach data to SIM Swap your number and become you. Capital One (NYSE: COF) Settles Nearly 100M Data Breach Customers

Capital One settles biggest data breach in history $190 Million Dollars

Capital One has agreed to pay $190 million to settle a class-action lawsuit filed by customers of the bank. Hacker, Paige Thomas, stole the personal data of nearly 100 million people in 2019. Thompson, in her thirties, is a former Seattle technology company software engineer Amazon (AMZN) Web Services. U.S. prosecutors stated she used knowledge from her previous employment at Amazon along with scripts to scan for Amazon Web Service (AWS) servers where “web application firewalls had been misconfigured.” Thompson was accused of ultimately breaking into a Capital One server and gaining access to “140,000 Social Security numbers, 1 million Canadian Social Insurance numbers and 80,000 bank account numbers, in addition to an undisclosed number of people’s names, addresses, credit scores, credit limits, balances, and other information,” according to the bank and the U.S. Department of Justice (DOJ). The Department of Justice court filing indicated that the former software engineer’s plan to find misconfigured web application firewalls is what led her to the information. She then bragged about the breach, attempting to share the information she obtained with others online. “The intrusion occurred through a misconfigured web application firewall that enabled access to the data,” The DOJ said. Thompson specifically posted on the information sharing site GitHub about her theft, and on July 17, 2019, a GitHub user who saw the post alerted Capital One to the possibility of it being the victim of a data breach. As soon as the company was tipped off, Capital One contacted the Federal Bureau of Investigations (FBI), and cyber investigators were able to subsequently identify Thompson as the person who had posted the comments. Upon executing a search warrant of her residence, investigators seized electronic storage devices containing a copy of the stolen data. “Capital One quickly alerted law enforcement to the data theft – allowing the FBI to trace the intrusion,” said U.S. Attorney Moran at the time, adding, “I commend our law enforcement partners who are doing all they can to determine the status of the data and secure it.” New charges were against Thompson in July 2021, postponing her trial. These included “six counts of computer fraud and abuse, and one count of access device fraud,” according to court documents. The charges came as cyber investigators made more headway into analyzing data they seized. For its part, Capital One’s settlement will cover the 98 million customers affected by the breach. Despite the deal, the banking company and its cloud services provider, Amazon Web Services, have denied liability. They agreed to settle, they indicated, “in the interest of avoiding the time, expense and uncertainty of continued litigation,” according to their filing in federal court in the Eastern District of Virginia. In 2020, Capital One also agreed to pay $80 million to settle regulators’ claims who had accused it of not being equipped with proper cybersecurity procedures as it made the switch to cloud storage technology. T-Mobile (TMUS) Faces 50 Million Customer Class Action Data Breach

Past T-Mobile Data Breaches and Lawsuits, 3 breaches in 2021 alone. This is not the first time T-Mobile has failed to protect its customer’s data. T-Mobile has reportedly suffered five recent data breaches. Hackers stole the personal identification data of millions of past, present, and prospective T-Mobile customers, leading to a huge class-action lawsuit. A massive data breach involving the personal identifying information of millions of T-Mobile US Inc. customers has led to a class-action lawsuit. T-Mobile (Nasdaq: TMUS) admitted Aug. 16, 2021. On August 19, 2021, Stueve Siegel Hanson and co-counsel filed the nation’s first class-action lawsuit against T-Mobile relating to its massive data breach affecting at least 54 million people. Earlier that week, reports surfaced that hacking groups stole the data of up to 100 million people from T-Mobile’s servers and were selling a portion of it on an underground “dark web” internet forum for 6 bitcoin, or approximately $280,000. T-Mobile later confirmed that at least 54 million people had their information compromised, including 40 million former or prospective customers who were not current customers but had previously applied for credit with the carrier. More than 13 million victims are current “postpaid” customers—or T-Mobile customers who get billed at the end of each month. The victims had their full names, dates of birth, social security numbers, and driver’s license information stolen. 850,000 prepaid customers—who fund their accounts in advance—had their names, phone numbers, and PINs exposed. It is very possible that additional victims will be identified as T-Mobile’s investigation into the breach is ongoing. Morgan Stanley (NASDAQ: MS) $60 Million Data Breach Settlement

Morgan Stanley (NASDAQ: MS) has agreed to pay $60 million as a fine to settle a lawsuit by its customers. The lawsuit alleged that the investment bank had failed twice to correctly rescind some of its outdated information technology that exposed customers’ personal data. Allegedly, failed to properly pull out some of its outdated information technology, and this led to their personal data being exposed.

The settlement of the class action was filed at a Manhattan federal court on Friday, Dec. 31, on behalf of around 15 million customers, but it still needs to be approved by U.S. District Judge Analisa Torres.

Shares of Morgan Stanley have gained 6.7% over the past six months as customers lodged complaints against Morgan Stanley. Complaints were for its failure to retire two wealth management data centers in 2016 before the unencrypted equipment was resold to illegitimate third parties. They said that the equipment was sold when it still possessed customer data, thus, leading to their vital personal information to trot out.

They further claimed that some older servers that contained their data had gone missing after the bank moved the same in 2019 to an outside vendor. Court papers showed that Morgan Stanley recovered the servers later.

As part of the settlement, each customer can apply for indemnification of up to $10,000 in out-of-pocket losses. Additionally, they will receive at least two years of fraud insurance coverage.

Security Breach NASDAQ AAPL Apple iPhone HomeKit Bug Make Useless

Apple devices exposed. A vulnerability in iOS that uses HomeKit as an attack vector involving very long device names, has been disclosed after a researcher disclosed it to Apple in August 2021.

As with its other products, Apple is keen on keeping HomeKit as secure as possible for its users. In a disclosure published on January 1, it seems that there is a bug in the smart home platform that could cause problems for its users.

HomeKit was introduced in iOS 8 back in 2014 as a way to control smart home devices from your iPhone from apps or Siri. One of the big benefits is the setup process, where you can just scan the HomeKit code printed on the device and your iPhone will immediately recognize it and set it up.

HomeKit has evolved since then, including the addition of the Home app, which gives you a central place on your iPhone to control everything in your house.

There are a ton of popular smart home products that still don’t support HomeKit, including the Nest Thermostat and Belkin WeMo line, which is some of the most recognizable smart home products on the market.

Security Researcher Trevor Spiniolas has called the bug “doorLock,” and claims it affects all iOS versions from iOS 14.7 onwards under testing, though it is likely to also exist on all iOS 14 versions too.

Furthermore, while an update in iOS 15.0 or 15.1 imposed a limit on the length of a name that an app or a user could set, the name can still be updated by previous iOS versions. If the bug is triggered on an iOS version without the limit and shares HomeKit data, all devices it shares the data with will be affected as well, regardless of version.

Calculations also showed that VZ isn’t among the 30 most popular stocks among hedge funds, for Q3. But why then are there less this year over year?

By comparison, 65 hedge funds held shares or bullish call options in VZ a year ago.

Is there something they know that the average investor or “APE” doesn’t? While every investor, in theory, * legally, is entitled to public information at the same time the Hedgies have always seemed to have an advantage. Whether it is naked shorting, Failure to Deliver (FTD), or just the sheer buying or selling power these Hedgies have they can swing a stock one way or another.

Unfortunately, traditional cell phone companies are not doing much to protect you. But it is not all bad news, there is a cellular phone company named efani that has stepped up and made it more difficult for hackers.

The holidays are here and hackers and scammers want your hard-earned money. Your cellphone could provide a gateway for cybercriminals to access all your financial and social media accounts.

The fraud is known as a SIM Swap, SIM swapping, SIM hacking, or SIM jacking, Cybercriminals hijack your cellphone number and use it to gain access to your sensitive personal data and accounts.

How it works. You access your bank account that uses text-based two-factor authentication. You access your account by entering your user name and password. Your bank sends an access code to your cellphone for you to complete the log-in process.

But what if fraudsters are able to change the SIM card connected to your mobile number? Giving them control over that number — they’d receive the access code to your account.
